FDN ATTORNEYS STOP SECOND FORECLOSURE IN IDAHO 33 MINUTES BEFORE FORECLOSURE SALE

FDN attorneys have essentially set a new record for stopping a foreclosure sale on short notice, with a Temporary Restraining Order being entered by the Court literally 33 minutes before the sale. This is the second Trustee’s Sale which FDN attorneys have stopped in Idaho since January 21, 2010.

The borrower retained FDN attorneys Jeff Barnes, Esq. and local Idaho counsel Monica Flood Brennan, Esq. on the afternoon of Wednesday, February 10, 2010 with a Trustee’s Sale scheduled for Friday, February 12, 2010 at 10:00 a.m. Mr. Barnes literally dropped everything to prepare the papers for Ms. Brennan, who filed the papers in Bonner County, Idaho District Court. The Temporary Restraining Order stopping the sale was entered at 9:27 a.m. today, February 12, 2010, just 33 minutes before the borrower’s property was scheduled to be sold at a Trustee’s Sale scheduled by Defendant Northwest Trustee Service, Inc.

The borrower has sued US Bank National Association as Trustee for a securitized mortgage loan trust and Northwest Trustee Services, Inc. as Defendants. FDN believes that this TRO is the first of its kind entered in Bonner County, Idaho, and is the second entered in the Northern Idaho District Courts after FDN attorneys Barnes and Brennan secured similar relief in Kootenai County (Coeur D’Alene), Idaho on January 21, 2010 for another borrower in a separate case.
